I dont think going to a 44mm will fix the problem at all.
There should be no reason a 38mm cant handle his setup.
Pics of the manifold please!
EDIT....... 44MM might help the problem if the manifold is improperly designed. I just thought that one through

To my understanding on WG sizing.. . And Tial can confirm or deny here. . . .
But a smaller gate should work fine as long as you are not trying to hold it down to lower boost levels or the manifold is improperly designed with WG placement
Bigger WG will work in either scenario, but allow you to hold lower boost levels if needed and maybe aid in an imroperly designed WG placement.
Please post a picture of the actual manifold. Im confused now on your comments about the WG placement

It's a Shearer manifold. It has the wastegate off the 5 bolt o2 housing though. I don't think the manifold has anything to do it. It might need a bigger wastegate because the 38mm might not be able to get all those exhaust gases out and the extra gases are spooling the turbo up more than needed...
It is a 6262, and the exhaust housing came directly from Precision so it wasn't touched, and I'm assuming the o2 housing was since the hole is a little bigger in the o2 housing than in the exhaust housing, so I'm assuming the wastegate hole in the exhaust housing needs to be ported out and made more smoother and matched with the o2 housing hole. I'm going to get that done in a few weeks and let you guys know what's up.
