I agree with all above, if it were the transfer case it would be more of a loud whine, and you would hear it increase in pitch with speed.
Edit: Can you narrow it down to a specific area of the car, or at least tell wether it is front or rear? Possibly rear differential, but like the transfer case I would expect that to increase in whine as the speed increased.
good luck

i do all the labor and my friends paying for the parts ... so its not too bad.
im just going to have to throw the car in the air and stick it in gear see what happens.

I dont think its the TC, every TC that i have seen go sounds more like a howl or old siren sound that is constant while at speed...never seen an intermittent sound come from a TC. Either way i would throw the car on a dyno and see if you can narrow down where the noise is coming from and take it from there. good luck

I have heard a few transfer cases on their way out in these cars, and every time it is a solid whine, never intermittent like this case. I mean, yes, it is a possibility, but I doubt it with a noise like that. Maybe it is the beginning phase of it, but still, I don't think so.
+1 to the dyno and just cruise and see if you can narrow it down while outside the car. At least that will give you a solid answer as to where the noise is coming from.
