Question For those who have or intend on putting down deposits

Out of morbid curiosity, what is the legal nature of these deposits that some of you guys have signed.

OK don't get all freaky on me, I'm just laying out possible scenerios.

If you ever, say, get into a situation where

1] the price is too much even though you are only paying MSRP (ie. the E7 comes as a $35K real deal full blown GSR) and you simply cannot or do not want to afford it

or

2] the USDM E7 is simply not what you want and you don't want it at any price (ie. E7 comes with 240HP, no Recaros, no FMIC, no Brembos, no ACD, much heavier, etc)... basically a WRX competitor and not an STi competitor

Of course we're hoping this never comes to pass and you never have to make such a tough decision but now the following consumer protection questions come to mind

1) are they non-refundable deposits?
2) can you transfer the money towards the purchase of another Mitsu car?
3) can you transfer the contract to someone else?
4) what kind of financial penalty is there to do these things?

I'd go into a Mitsu dealer myself and ask but there aren't any in this frozen wasteland.

If [1] happens then I'll actually be happy. If [2] happens, I'm out $500. And life goes on.

Note: I probably could get it back if I tried hard enough, since I bought my current car from the same dealership.

Worst case scenario you could probably sell your space to someone else who really wants an Evo. My friend did that for the M5.

The deposits guarantee you nothing. All you are guaranteed is that they will sell you a EVO if they have one left. And Mitsubishi put out a memo to all dealers that they will not accept deposits on this car until the receive the build sheets. And this is not a rumor this is something I read with my eyes.

I put down $500 last April and got a bill of sale on which the sales manager wrote that I'd get the dealership's first Evo. It's a refundable deposit.

The one issue is price. I asked him what would happen if someone else came in and offered some astronomical number and he said they'd try to be fair to me if that happened. For what that's worth! They wouldn't agree to MSRP and I can't blame them.

All mitsu deposits are refundable per ron mabry at huggins mitsu here in dallas. He said it is a company policy and not a dealership decision. If they say you cant get your deposit back then you can contact mitsu and file a complaint in which you will get your deposit back and a a free oil change coupon.
