Because the system works us just as much as we work it. If the smart people actually put the effort into researching for the purposes of defending themselves (and win), then I say it all evens out. The people who enforce the law aren't always good samaritans with perfect records.

Cops aren't stupid, but you're correct, they aren't judges either. A judge renders verdicts. A cop shouldn't with his "discretion."

Actually the law really reads "what is safe under the given circumstances" in just about every state.

Why do you think an officer can use discretion to either write you a warning or a ticket.

As far as I am concerned 99% of ticketing is a racket and revenue generating scam run by local law enforcement.

If a person is going faster than the posted limit but signaling and making a good lane change then too bad. Go worry about something else like REAL crime.

There are enough people getting shot, stabbed, raped, assaulted, fires, emergencies, etc. that should require more attention than someone in a tuner car going 15-20 over the speed limit.

Another fine example of local municipalities using TAXPAYER monies to engage in rediculous endevours.

If you play your cards right and don't get more than 1 ticket for a moving violation per year, most places will suspend it for 1 year providing you don't get another moving violation within 12 months.

That cycle can go on forever...

Basically for me it comes down to knowing the area you are in and feeling comfortable, competent, and willing to live with the "what-if" consequences.

In my opinion there is such a thing as a safe speeded. I for instance will do 15-20 over but keep good distance or be out in front of traffic, signal, and not swerve and make erradic lane changes or drive like an idiot in general when going a higher rate of speed.

When I know I am busted I pull over right away and admit my guilt and I have never had a problem regardless of how fast I was going.

you forgot about drunk driving! drunk drivers should be fined up the a$$. especially when they hit some one... like me!

be careful out there. there are more dangerous things on the road than going 10 mph over the posted speed limit on an open road. such as all the old people out there who have had their turn signals on for a half mile who could strike at any moment!!

Spelling correction above - 'safe speeding' is what I meant to say.

It's kinda funny because most troopers actually have thanked me while I have waited for a minute or two while they turn around to catch up while I am on the side of the road.

I think 9/10 law enforcement people are surprised in general when you actually will tell them the truth about how fast you were going and preceed it with "I am not going to lie to you, I was going this fast", their mouth kinda drops to the ground.

At least for me...

Anyway, good for you on going to court. For the people that indicated you should have taken it up the shoot, I wonder if they know you have a constitutional right to an attorney or to act on your own behalf.

Besides if the ticket was SOOO important and you should have paid the fine and not questioned anything, then why was the cop not in court for such in important matter?
