okay need some advise, my lawyer is out of town for awhile and i am getting impatient. plus the paralegel is charging me to talk to her on the phone.

should i use ADR to settle this before my court date (3 months away)....i found a forum of the specific dealer and have this long elaborate rant i have prepared to post on there that basically said i have enough evidence to prove that this is a wrecked car and that any mechanic can tell that...so why don't you save the trouble and buy my car back and cut me a check $32000ish and we'll call it a day. because i am sueing them for $82000, plus court fees.

this would get the remainder of my retainers fee back too

Why would you jump the gun? If I were you, I would not speak with the dealership without your Lawyer or offer anything other then what you stated earlier ($82,000). Did your lawyer advise you to do this?

I know it's tough, but be "Patient".

82000...under DTPA you are eligible to sue 3x the damages (which is my evo)


i am getting a bit unpatient because my evo is not really drivable. im a college student=low on $$$. i have to use other ppl's cars to get around. from my standpoint, i want to get out of this deal as fast as i can. it is pretty commom to settle out of court...a lot cheaper for both parties

update.

1 day before i was set to go to court as the defendent of their $4000 claim...North Texas Nissan drops it.

my lawyer found where they tried to **** me over. here it is:

on my department of motor vehicles title receipt...it shows that my trade in was for $16500...which is crap since they had to pay it off for $10800. So in reality they gave me $12500 (16500-4000) for my trade and recorded it on record as if my trade had no payoff. This is why they wouldn't give me my paperwork b/c it would clearly show where they messed with government and bank documents...good move on their part.

so then I hit them hard with a 8 page original anwser showing how they knowingly sold me a wrecked car, so the SOB's want to settle out of court (typicle pansies)

Do everything you can to get this to court. Don't get "impatient" again. It's hazardous to your legal health. Do everything your lawyers tells you. Nothing more and nothing less. When a poor college student walks into court to fight a big car dealership you're already ahead in the eyes of the judge. If everything you've said is accurate and documented it's not totally unlikely that the judge will award you the full asking amount in order to make an example out of them. Please keep us posted!

on a lighter note, i highly recommend going to http://www.ripoffreport.com to search real consumer complaints about several businesses...including car dealers.


furthermore, if you want to give North Texas Nissan some crap....they have a dealer moderated forum dedicated to *** kissing http://dfwstangs.net/forums

...they banned me, so i can't give them anymore e-crap
