Getting out of a Ticket!!!!

Ok so i usually go to court for my speeding tickets or any ticket that i get, and also tell my friends what to do, and usually get them reduced to soemthing that won't affect the insurance, anyways long story short

Got pulled over Christmas day in my winter car (93 Tempo) at like 7:00 in the morn, by a city cop that doesn't have radar in his car, and plus the car was one of them cars that went to schools for the kids around here its called the D.A.R.E. car its was a monte carlo with flames on it. well i tried giving him a sob story but didnt work and he seen my radar detector and said because you have that i wont reduce it at all. Plus he said he had to go 60 thru town to catch me. i was going thru a town i never go thru for christmas, and i thought the zone was a 35, well turned out it was 25, and he said he paced me at 48, what a retard, gave me the ticket and stuff. Then yesterday a rec'd a letter saying he put the wrong court date on the ticket. do yo think i should not show up and not send in a plea, and tell the judge i never got the notice? Or send in a plea and say that this guy wrote the wrong date on the ticket, and it was on christmas day at like 7:00 in the morn and where's the christmas spirit? i was hoping that they would maybe just throw it out becasue i live no where near this town, and maybe drove thru it once before this? what you others do in this case?

A- Not go to the Court date nor send in a plea, and tell them i went there on the date specified on the ticket and it was the wrong date and maybe they will throw it out or be a little more lenient with the 210 dollar fine and 6 points?

B- fax in my plea a week before the court date and say i rec'd a notice a week before the court date, and tell them that they need to figure out how to run the show, and put the correct date on the ticket because i am not from around here and have to re organize my schedule and i can't make it due to lack of organization?

well, u have a couple options.

1. go to court and face the officer and take whatever u can get.

2. do some research, ask in court how accurate the officers pacing ability is, and let the judge know that u were new in town and u thought it was 35 thus the reason u were doing 35 in a 25. tell them there is no way the officer caught u doing 48 for 2 simple reasons, 1. ur speedo was reading 35, and 2. the officer was not shooting radar, which means he is not accurate on the pacing ability or ur speedo is wrong which in that case would be a fix it ticket.

3. (and the option i use the most, but im sure will get flamed for obvious reasons). call the precinct for about a month everyday and find out which days per week the officer in question has off, and reschedule your court date for the day in which he has off. ive done this 3 times and theyve never shown up for me, but YMMV.

if you go to court more than likely it will just get dropped to practically nothing... you should never just play the i didnt get the notice game... they dont care... it will just postpone your date till later or do something worse....i'd go talk to the DA before the case is suppose to appear in court, just be straight with them and they will take care of you

The truth as I see it in two options.

Option #1 - If you were trully wrong and you know if you were or not then man up and pay it. That is the only way you will learn to not speed and to obey traffic laws. (i.e. Hold yourself acountable!)

Option #2 - If you were trully innocent then fight it to the end.

Your call as I said earlier only you know the truth.

thats pretty sweet, i mean yaeh i was speeding, i was going prob 40-42 in what i thought was a 35, i mean you can't tell me no one here does 5-7 over the posted speed limit everywhere. plus christmas morn man. what a scrooge. but yeah i do like the call the precinct thing everyday hmmmmm

Oh yeah the officer openly admitted to doing 60 thru town, but thats ok cuz he can. i think on my travels christmas morn with the 2 hours i was on the road i passed like 2 cars going both directions, i mean its not like it was busy or anything where he should have even cared if i was speeding you know(to a certain extent), i guess he was pissed he had to work christmas day?

One take it to court. Ask to see the certified calibration of his speed odometer for the vehicle he was in. More then likely if it's a D.A.R.E. car it will not be calibrated. Ask for his certification for pacing and find out how long he was pacing you for cause he has to pace you for a certain distance. For finding out when he is off is Funny cause I get paid overtime when I go to court and if I am there for 5 mins. Or 3 1/2 hours I get paid for 4 hrs OT because it’s my day off.

they really have to have a certificate for pacing?? WOW thats news to me i like it tho. Is this true in all 50 states do you know?

yeah he wasn't pacing me for no time came up about 200 yards and just pulled me over never stayed behind me for anytime. just assumed what i was going

hey, im not saying they dont get OT, but the 3 times ive done it, the officer has never shown up. if i was an officer 4 hours of OT to come in on my day off isnt worth the drive / uniform/ chance the dude will get ppj / etc etc. and im sure the 3 guys who didnt show up throught the same thing, lol like i said at the bottom of that ymmv "your milage may very"
