also they installed the Clutch for me..it's act clutch..for the tbe and fmic i believe i can fight for that..but what about the clutch? they will take that against me..

"They"... did mitsu install the clutch? regardless, if you have an aftermarket clutch, your fu*ked. someone correct me if i'm wrong here. $5000 sounds a bit high for a t-case repair though. I hear it's closer to $2000 and their is a performance shop on the forum that rebuilds t-cases.

If not covered your best bet is to send it to shep or tre, get the lsd while out.

my problem is bad t-case but the tranny is okie also one of the front axles on the right got loose..

In a word, NO.

This will only cause more damage, kinda like driving around with rod knock.
