The tires have to be within 2/32" tread depth, otherwise you could run into problems. I called both Mitsu and Yokohama and both agreed that you can't just replace one new tire with three used tires. You can't replace a pair either. This is for AWD cars, but even more important for cars equipped with ACD.
My advice would be to have them buy you the new tire and also have them pay the $25 or $30 to have tirerack shave the new one down to the level of the other 3.

i dont know about how it is everywhere else but here in utah if you get in an accident and its not your fault but for some reason your insurance company has to cover it they can not legally change your rates. start as much **** as you want but it is just a tire, whoever hit you could have done a lot more damage right? I would take whatever they will give you.

Why should they pay for all 4 tires? The purpose of insurance is to make you whole again. They are only responsible for the item that was damaged, and getting 4 brand new tires b/c one damaged is out of the question. If you got a flat tire would you replace all 4 tires?? I doubt it. Making a stink would only be wasting your time.

Replacing one tire WILL NOT damage the AWD system. I have done this many times on other awd cars, including my Evo. Just make sure the proper amount of air is in all four tires, and take a yard stick to measure the overall running diameter of the wheel, and make sure they are exactly the same on all four sides. If the new tire's diameter is slightly larger than the other four, let a slight amount of air out of it. Usually the diameter of a new tire vs. the older tires are almost the same anyway, and any differences are negligible. Try keeping the new tire on the front, until it has worn down evenly with the other tires (remember the rear tires wear WAY slower than the front tires, since the front tires have to steer and accelerate).]

what i meant by the insurance company moving his rate up is, if he ever puts in a claim and they look at his history, they can and will jack his rate through the roof if they want. my gf was an insurance agent for geico and she says with claims its kinda like however they feel that day is how much there insurance moves.
