Just tell them to keep the car because its wasted and buy you a brand new IX. It might work!

I'm so sorry to hear about this unfortunate event. What is the address of the garage that employees these guys? Do you have any idea where he hit the tree? There aren't too many trees in old city, I'd be curious to know how far he took the car away from the lot. That would also probably be an important factor if a lawsuit ensues. If you can prove he was "joyriding" it, it would certainly take away from their defense.

no matter the circumstances, i don't believe there would be any legal defense for the damage, even if it were in the parking lot because of another car. when someone volutarily takes possession of your vehicle to provide a paid service, they are responsible for any damages whether it's a result of negligence, recklessness or actual willful conduct. the only aggrevating factor here is that it likely was a joyride and depending on pa law, you might be able to get more than the cost of the repairs/replacement in the form of punitive damages. definitely see an attorney and when you do, find out who will be responsible for his fees. you may have to pay up front, but your type of suit may allow for the recovery of attorney's fees.

my friend is a valet...and he tells me that he gets on all the high end cars that come in...so...i already knew that they rape our cars...that's why i don't even waste my time w/ valet...not the cost...but the fact that ...the car will be romped on, and seats adjusted ..and what not... again

good luck...i would go and seek out a new car ...

Wow. Jim man, that blows. Sorry to hear that someone could be so careless. Just wanted to let you know, if you need any help with anything throughout this headache, please don't hesitate to ask man.

I did the same for someone else pretty recently when the insurance company tried low-balling on alot of stuff, after his car was vandalized.

Anyway man, good luck, and again sorry to hear this..your car was a beauty.

little more info for you philly guys.. i was at mad river, but used world fusions valet.. its the same guys for all of old city i think Worldwide Parking Inc. DBA "Royal Park"

according to the cop he hit a tree on delaware ave. i didnt see where the accident happened bcause the moron drove the car after he wrecked it. its been parked at the parking lot for the waterfront.. you know the place where you can take the ramp to go back up into old city on market st from delaware ave.

im waiting for the guy to call me now. i already told him at a minimum i am getting a new clutch and flywheel on top of all new body panels ect.

my lawyer in mass seems to think i have a case for considering the car stolen, but it think that might be him being over zealous. but then again mass and pa are different.

anyone local know a mitsu dealer that does body work? i tried calling victory mistu but they dont even have voicemail (so shady). i want it to be done at mitsu so it is as expensive as possible.
if the frame is bent at all, i will not accept the car back plain and simple. if thats the case i will have a team of lawyers on these people.

Good man, be as tough as possible. Treat this like business and give it to them. Don't settle for anything without talking to your lawyer. From what you are saying, it sounds like he is tough.

did you try faulkner mitsu?
they're suppose to be collision specialists

thats f-ed up right there, i was thinking the same thing as your lawyer about being able to say it was stolen. because he did not have permission to be driving it everywhere. i say get as much as you can out of them, and prosecute to the fullest extent of the law everyone you can.
