That sucks but it isn't that much damage. Looks like a bumper and exhaust will need to be changed. As long as your a little handy and can take the bumper off to check what will need to be replaced I would just get the cash from him. But if you don't want to deal with anything you can just take it to a body shop and have them take care of the insurance claim. I would also go with a jdm IX bumper and an aftermarket exhaust.

+1 to the jdm bumper and exhaust. Think about it, good old cash doesn't raise your insurance. Making a claim could. It doesn't look that bad. If it was really crushed, I'd say claim it because you wouldn't know what damage lied beneath. But that looks pretty cosmetic. I'd take cash+pain and suffering. I hate it when people don't watch where they're going. I've been rear ended three times, so I know the feeling. The last time, I was so pissed that I was laughing at the scene of the accident. Call it temporary insanity. I had a really rough year that year. But anyways, yeah... get cash+pain and suffering.

How about we encourage people to stay honest.
lord251, please don't listen to the individual's suggestions quoted above. The safest route is to go through insurance to guarantee a problem free fix. If you feel comfortable with the guy paying you up front with enough cash to cover the repair and an unexpected finding when the car goes into the shop, then you may want to give the guy a break.
