Mitsubishi makes restrictor pills in few places because of reasons like this. If they did not build a safety net for normal driving mishaps like this, it is their fault. If they don't have solution for safety in Alaskan conditions, they should not sell the cars there at all.
You should also emphasize that such design flaw almost cost your life (I know this is way exaggerated but it seems how lawsuit works in the states...). Definately threaten then if you don't get any response, get a lawyer.

I said about the lawsuit that way cuz im from Hong Kong -)
For condition they can always exclude certain states if they have regulations (like CA if the cars don't meet emissions, or AK and HI not being included for certain shipping). So if they cannot back up their products to conditions of the place they're selling they shouldn't sell there at all.
