I am not sure of the smog/emissions laws in MA, but in California the car would have to be able to pass the test before the dealership can sell the vehicle, otherwise they have to return the car to stock before selling. I would hope you really search and research this car as it is a dealership he should have pictures up seconds after taking that car in knowing it would sell. Seems really shady to me, but good luck with whatever you do and find. Keep us updated.
