If your in san Diego and go to the ref. The one in southbay is also a collage automotive teacher. You won't be able to put something on your car he has not seen before..and he is also on the CARB board so..any visual Mods should be put back to stock. If you can take your car to be signed off at chp, I would do that or pay the fine if possible!

What rpms were you cruising at and shifting at? I drive by cops and get passed by cops all the time, and they don't stop me. I shift at 2500-3000 (20% throttle) and cruise around 3000rpms. Touch Wood.

Yeah, i would fight it in court. File for an extention at the last possible time, then TBD, then have your day in court and hope he doesnt show up.

Thanks for the info kwanza. Greatly appreciated. And yeah my ref apt. Is at the college in south bay. Now im a lil nervous lol. And to answer your question pure evoix. I cruise and shift the about the same as you. I was just driving through a quite neighborhood, my neighborhood, at 2 am on my way home from work. Probably the only car on the road.

You don't have to live here, your state has already adopted Cali's smog regulations. Soon enough every state will too. What I think is really funny, is that anything 1975 and older is exempt. And hey Powerspeed06, I would go to the police station and file a formal complaint against that officer for drawing his gun on you and for having no legitimate reason for stopping you. I think he can face actions for having his gun on you for no reason. Good luck on the ref appointment.

Thanks for the support guys. And a complaint will be filed cuz that stop was wrong in so many ways. But regardless of that...I've gotta be street compliant. We will see how this test goes. I Will post test results and share any info I get about this for others who may, unfortunately, encounter this situation.

So I went to my ref apt. And this guy goes over my entire car looking at everything. He even finds a vacuum line on the underside of the throttle body that had been accidentally blown off at some point. He even checked fluid levels. After the visual inspection he started the test for the loud exhaust. He revs up to 4175 rpms. It passed at 89 decibels. Need less than 95 to pass. Then the emissions test. He was unable to perform a "loaded" test cuz its an awd car lol. He plugs into the obd port. Revs up then idle for a few minutes. It passed!! Then we go into the office and he looks up my aftermarket intake and finds that its legal. Everythings going good. Then he says my bov is illegal and therefore I failed the test. Any bov other than stock in california is ilillegal. But the good news is that's the only thing I need to change. Not bad at all. Now I just gotta find a stock bov to borrow lol. Oh and it cost $120 for the tests.

i cali also and dealing with cops here specially in central were we had the whole cops against street racers and CHP driving in town .. which they do hood pops on any cars they feel fit. which then was just hondas, now its any import!

exhaust you can fight him when he was there...

You can ask him what code is he putting exhaust under. because there is 2 codes. if he rights (a) on ticket its noise violation which you can ask him if he as a DB meter because greddy tunes there's to pass california DB limit (he doesnt know cats missing)
if he wrote (b) they added that one for imports
Moddified Exhaust! screwed. they do that so they can let harleys and domestics run loud.. dicks

If you didnt have an exhaust he can not ask you to pop the hood because he did not have probable cause.

if you have modded parts under the hood and they came with carb stickers point them out he cant ticket you for those because they are C.E ...

good luck.. i would honestly hook up with a friend who is stock or a friend who is modded and kept his stock parts for this reason alone..

Good deal man, now just email Injen and ask them to send you a CARB decal for your intake, borrow a stock BOV and get your car back on the road. Then take that jerk off cop to court and have the judge ream him a new one for being ignorant and uneducated about Cali smog laws.

I've heard that Mr. Ticket has gotten people out of ref tickets, just something to keep in mind. Also for anyone that can answer this question, lets say I have an evo 8 which stock from the factory comes with the plastic bov, if I got reffed would the inspector fail me for having an evo 9 metal bov?

He gave me the (a) violation. But I didnt have any say in the matter. They didnt even ask to look. They just did while I was sitting in the back of the patrol car.

From what the ref told me...any change to the bov is illegal. But with that being said..will he/or any cop that pulls you over, notice that its a changed part. They are both oem mitsubishi parts. Either way its a very simple switch back if you absolutely need to.
