Possible lawsuit / glazed flywheel

I am mad as hell and I don't think I/WE should take it anymore.

I had 9300ish miles on the car and was told my flywheel is glazed and it will not be covered. I have not abused the car and only have the Xede piggyback units on the car, it added about 26bhp. NEVER been to a track and it's a daily driver.

1. Can or should I post my 3 page+ MS word doc. rant that decribes in more detail (milage when trouble started etc.) the trouble I have had with this clutch assembly, the conversations (paraphrased) I have had with the Mitsu. food chain of personel and my future plans as a result of this situation?

2. I respectfully ask that any vendor, tuner, mechanic, magazine editor/writer send me your hard facts/opinions regarding the clutch in the EVO 8. Is the stock clutch in a stock or near stock EVO 8 up to the task or is it not?

3. At this point, especially if you live in Illinois, do you feel that you could benefit from possibly joining in my case if it gets that far??

4. If the lawsuit looks too expensive/too time consuming for the end payoff, would you be interested in participating in a roadsign type protest in front of your "favorite" Mitsu. dealer in the near future?

The attorney I plan on using has asked my to obtain further written and mechanical evidence regarding this issue, so this is where I am starting. At this early point he definately thinks I have a good shot a winning!

Please PM me or post here if any or all of this sounds like a good idea.

By the way the Mitsu. dealer(s) I am dealing with is Max Madsen Mitsu. in NE suburban Illinois, they have 3 stores.

OH BROTHER! What the lawyer you are using sees is a fat addition to his bank account out of your pocket. You may be fortunate enough to win a decision that mandates your flywheel being replaced under warranty. You may be extremely fortunate to win some minimal damages award. You will almost assuredly pay more to the lawyer than you will recoup.

Have you been to more than one dealership to try to get warranteed? Have you checked the cost if you had to pay it? How does the cost compare to what you will owe the lawyer?

maybe if your car was stock then your could pull a law suit...since you have the xede....there goes your warrenty.

Only if the xede can be proven to be the complete and only reason for the demise of the flywheel....

There are still a few people out there that actually sue because of the principle, not to just get money. In most cases they will pay more for the lawyers than what they will get in return. These people actually make it better for the rest of us (for example it may lead to a recall and clutch redesign) unlike the people who sue soley to get something for free and make the world a crappy place (for example, the spilled McDonalds coffe on the lap while driving thing)

I have no idea what the goals of this suit are, nor do I know the individual. My car is stock @ 6000 miles and the clutch is fine. I hope it lasts like all my other clutches in other cars (ie: over 100K)

I would move on....bite the bullet. remove the clutch restrictor, install the ss clutch line and get a cusco twin disc thrown in and then start calling around for those HKS cams...just my 2c

This is a common misconception. ie *wrong*

Only if the mod caused the warranty claim, is the warranty voidable. I repeat, voidable. The warrant is *never* void in whole until it lapses.

Nobody sues for principle when they know it will cost more than the recovery. People sue because our society is so litigious and because they expect to come out ahead, plain and simple. The lawyers of course encourage it no matter what because they are going to win whether the client wins or loses. They don't make things better for us. They are a portion of what makes things worse for us by adding HUGE amounts to the cost of everything to pay for liability.

yes i kno about the whole warrenty thing...obviously if you have a mod that will increade HP and TQ then you will obviously increase the wear and tear on the clutch and flywheel (decreasing its life expectancy) hence voiding your warrenty.

I'd be more than happy to issue a written statement (if this goes class action) stating the "burning smell of clutch" during hard accleration (when stock) and the notchiness of my shifter (when stock).

I have since installed the ss clutch line and removed restrictor and have not experience either of the above after modification.

In stock form, this car definitely has some sort of engagement/disengagement issue. Some of the guys on here have stated that their car pulls when their clutch is fully depressed (I believe in the cold). This obviously is something that could cause glazing of a clutch (consistent friction, even when the clutch is depressed).

I've seen too many "clutch gone" posts from folks with less than 10k miles for me to believe nothing is wrong. I'm just waiting for someone with the technical know-how to make a post on here telling us the TRUTH.
