Well my car is back in the shop yet again
Like the topic says, my car is back at Elkin's Mitsubishi yet again. Yesterday my car started making some strange noises so while I was at school me and my automotive instructors rode with me and took a look at it and thought it sounded like a bearing in the transfer case, and it sounds like my syncro in 4th gear is out (a complaint I had earlier that for some reason the dealership couldn't "duplicate") and I also had to get them to check out the check engine light once again. My car has been in the shop for over 6 weeks all together now.
I dropped my car off yesterday and they gave me a call this morning telling me that i'll need a new transmission and transfer case and that I have to pay for it. They haven't even checked to see if I really need to replace both or whats really wrong with it. I was already pissed enough about having to replace the clutch and having to pay for it and around $1000 in labor. They are also telling me that it was the clutch that caused the "transmission to go out and transfer case". I think it's bull**** that i've owned a car that has 10,060 miles on it and I needed a new clutch and now a new transmission and transfer case.
I loved this car when I first got it but i've had it, i'm through with this car and I refuse to ever own another mitsubishi. Also tomorrow i'll be calling MMNA to report my complaints about Elkin's to them along with the BBB and my lawyer.

Elkins...as in Elkins, WV?
I don't think it will be hard to get this covered under warranty. Your problem extends beyond a wear item. They might have a fighting chance trying to deny your clutch claim, but a transfer case? Throwout bearing? NO WAY. Neither of those items should wear out, whether it's due to drag racing or not. Throw out bearings should last at least 60k miles, transfer cases and transmissions - hell, 150-200k miles.
Remember - the squeaky wheel gets the grease - time to start squeaking.

Geez, six WEEKS in the shop and only 10,000 miles? Wouldn't the lemon laws come into play here?
You have to watch all auto dealers, they'll try to keep you from finding out how to proceed. Unless you do a lot of research, they are always in control and the little guy gets screwed.

Well, it's too late to read about the drag racing but here we have another car driven outside it's design parameters and intended use and now when something is wrong the crying starts. It's too bad every Evo doesn't come with the black boxes that some cars have so the dealer could plug in and know for certain how it's been driven. Then they could easily determine what's warrantable and what isn't.

LDB- I don't understand what your trying to say here accept your trying to say that I drove my car beyond its parameters (racing? isn't this a rally breed car?) you can say what you want but sorry my daily driven car was not abused like you would think nor like 98% of the peoples evos on here that have had to replace their clutch below 10k miles. Sure i'll go ahead and repeat what I said earlier in this post, yes it has been to a drag strip once. Was it driven like it should have been to get the best time out of the car hell no it wasn't and it never has been, I got a lemon car and thats that, matter of fact I believe my car was used as one of the dealerships around raleigh as their "test drive" car so i'm sure it had a rough life before I even received my car with 67 miles on it.
matt55- I have an Exedy Hypersingle in it right now, I find them hard to work with I haven't had anything but trouble out of them. Matter of fact, I had some things added to it when I first got my car there and they didn't know how to put anything on and then when I had to get my clutch put in it sat at the dealership over 3 weeks, 1 week of it was just the technician going out of town to get training to put the clutch back in the car.

Well, Elkin's is trying to claim that they told us that putting in the Exedy Hypersingle clutch would void our warranty on the whole car (which they never did) because its an aftermarket part. They are saying that because we put that clutch in it caused the transmission and transfer case to go bad. This is total Bull$!@#. So if anyone could help me out and check the warranty or anything please let me know. Thanks

I apologize for any misconceptions. When the one guy said delete your post about all the drag racing it sounded like the car had been raced a lot.
They are full of it in regard to voiding the warranty on the whole car. There is a federal law, Magnusson Moss, that specifically prohibits them from voiding the entire warranty. They can argue that an aftermarket part caused the failure of another part however to deny warranty they have to prove that it caused the failure. They can in no way just arbitrarily "void" the entire warranty.
Sounds like you need to find a different dealer to work with more than anything else.

I don't *need* a new clutch I already have a new clutch but this isn't about why I needed a new clutch to begin with, I don't drag race, I don't road race, and I don't autox but I'm being accused of drag racing hence the reason I had a "racing" clutch put in, anyone in their right mind would put in a better clutch if they had to. I'm being told that becasue I had them put in the new clutch I voided my warranty and its what caused my transmission and transfer case to go bad.
