Did they document (Mitsu Dealer) your mishap with the missing drain plug and lack of fluid, or was this just discussion based with them?
If it was documented what happened, I'd bring it to the dealership and talk with the Service Manager. If, and when, they deny your claim, take your original paperwork, and goto the regional rep.
Only problem with all that, is time.

that sucks man. Mine is on the way out as well. Before you go spending 2k, let me look at the transfer case. Unfortunately mitsu doesnt offer parts for them. They have some outside company make them. The same company that makes the 3000 gt ones. Those you cant get parts for either. We got one from a crashed car and rebuilt it. It seems they are coming with way too much end play from the dealer, causing premature wear and whining noise. We removed the shim and dropped the center diff down ... re-shimmed the top and that tightened up the end play. That one is going in a cusomers car on monday, so we'll see what happens. He was having the same noises but had already modded his car and couldnt get it warrantied. Worst case we can rip yours apart and see what happend. I know you use your car as a daily so we might be able to swap one out until we figure out what to do with yours. This is all assuming you dont go back to the dealership .. Let me know

It's an amazing thing how quickly a big Corp will leave an employee out in the cold when there name is not on the suit (mis-deeds of the employee unknown to the employer). As you can see, my answer is purely one of retribution vs. the recovery of losses... I'll drain the offender dry no matter win or lose. I've found it makes me feel so much better to be the ****er vs. the ****ie. In a few cases, the problem was magically fixed when the individual received the summons.

I like your thinking. Suddenly the repair that wasn't warrantied is magically "fixed" under warranty. Hmm, maybe we should all file suit against our service managers. Then we'd get some stuff done. BTW, I am mostly kidding. Mostly...

Yet another evo today with a bad transfer case. This one had 2k miles on it. A whine that even a radio couldnt drown out. This guys car was stock as well. He'll be paying mitsu a visit. Keith ( from our shop ) is getting a new rear , 2 days after picking up his car he has a horrible thumping noise in the rear. Mitsu said " lets try changing the fluid first " LOLOL yah ok that will work. The worst part about the whole mess is that you cant buy parts for them. The transfer case we just shimmed for a customer is fine so we'll see. I guess time will tell
