Evo IX seat leaning/not straight

Evo IX seat leaning/not straight
Hi all,
I have an evo ix and the drivers seat back isn't straight. When I sit in it, the right side visibly leans out. I'm not sure what the issue is, I took a picture of what I think holds the seat straight (the piece there has a round cap that goes over it, but that cap doesn't seem to offer any stability) the issue is but this looks just like the passenger seat which doesn't lean. Any advice?
Does this bolt tighten??
