If it really is detonating, you determine that by reading the plugs...not a 30 second test drive. I assume you're confident you don't have bad fuel in there. Put in half a tank from the biggest brand name station in your area, and top it off with some 100 unleaded. If the problem is still there it's probably not detonation.
If not detonation, why not just let the tuner remap it? Everyone agrees the OE map sucks. Yeah, it's a pain when it comes time to take it in for warranty repairs. And it's green out of your pocket. But you're already spending a pile...might as well spend a little more to allow you to really be happy with your ride.

I have both flashes and my acceleration is still not smooth, plus the loud vibration coming from my shifter at high rpms, plus my syncros are going again(all sycros were replaced under warranty already)...I'm in the same boat as you.
Don't know what to do anymore.
I regret trading in my evo IX, had no problems with that car for the 20k miles of ownership.
So I suggest you do a lemon law.

lemon law it and if the dealer gives you hassle call your local news. If they have a "waste busters", and let them do a report on the dealership. they sure don't want the bad publicity.

I would not due a lemon law. You will end up spending time and money, and then not getting a new car anyway.
Since you got in another car and it does the same thing, wouldn't you just think that's normal then? Why does every Evo have to be defective?
I think sometimes you guys make a bigger deal out of it than what it is.... I agree the base map might not be the best, but is it really THAT bad??
Did you try a drop-in filter to lean it out a little?
I don't think it stutters as much as it is the tune. It comes on strong, and then kinda fades off. That's what all the cars do. I don't know how you think that determines a lemon law...

Its not that the car comes on strong and then fades... its accelerates sporatically. It is choppy and it feels like little cuts in power.
It acts as if the ac is on full blast, or not warmed up yet. It does not feel right.
