Dealer and corporate stand off
Welcome! Long story short, my Evo is damaged and I'm not quite sure what to do next.
I picked up a Evo X FE new on April 30th. (second Evo, first was a 2006 9)
I got my first oil change and 27 point inspection at 2500.
At 2757 miles my drivers side wheel had two lug net come loose and the wheel came partially off the hub while drive with my wife. Car was towed to closets dealer (they did not perform service).
The first dealer said this would not be covered under warranty. I called corporate and they said the same thing.
I had the car towed to the dealer that performed the service and they say the hub is defective, but they cant do the work because the VIN is flagged.
I call corporate again and they say it will not be covered and that what the service manager is telling me is not what he is telling them. I ask for the case to be elevated and talk to the corporate manager. He says its clearly negligence and the dealer "should do the right thing" but they can't make them. He says talk to the GM.
I call the GM of the dealership and give him the break down of what has happened. He says he will make some calls and get back to me. I don't hear anything and I call the next day and talk to him again. The GM has the service manager call me since he talked with corporate a few hours ago. Service manager says corporate will make the "final call" and then I call corporate and they say its all on the dealer.
The service manager says they never touched the wheels, and that checking the brakes as part of the 27 point inspection is only a visual inspection. which brings me today!

Stock wheels. No mods on the car. Garage kept all the time.
Damage, 3 broken wheel studs, wheel hub, wheel, caliper and rotor. That is the damage that I can see.

How can you check/inspect the brakes properly with the wheel on?
Ask them which is it? Is it:
1. Fraud. They charged you for the inspection and didn't do it.
2. They did the inspection properly and didn't torque the lugs (most likely).
3. The factory didn't torque the lugs and it wasn't noticed on either the visual or in removing the wheels...
What is the cost to do the repair? That will determine if a lawyer is warranted. No point paying $3K for a lawyer to settle a $1,500 repair... Jus' sayin'
Check with Better Business Bureau too.
Be persistent! Document everything!
Let us know how it turns out.

visual brake pad inspections are pretty normal you can easily see how much pad is left with the wheel in place. Pretty much just looking at the squealer and how far away it is from the rotor gives you a good idea of how much is left. Although I don't see how the dealer isn't responsible for this I mean you trusted them to keep your car in tip top shape and they let you out the door with loose lugs...sheesh mitsu dealers suck

Am I the only one that checks my lug nuts before I drive off the lot or off the property of the garage after I have work done? I mean, it is your life at stake. People forget. It is what it is. I have heard of this happening far to many times before.
Anyways, If they took the wheels off and put them back on without tightening them back top spec I don't see how this couldn't be their fault.
