Too bad they are tearing it down. If they have not begun to tear it down then go and take your vehicle and put
some miles on it asap and wait at least 1 more month. I worked at a dealership for 6 years only doing 3rd party warranty claims.
The dealership would often sell cars with problems like yours not telling the customer, but make sure it was sold with warranty so that 2-3 months
down the line the warranty will cover that issue. We would usually put the customer in one of our many loaner cars for months and
put miles on the car our self until its time to file. Does the car have an intake or exhaust? if so they will denied the claim. The inspector comes in and takes many pics of
the vehicle which are sent back to the Warranty company on the spot. if they see any modifications they can and will deny the claim.
Read the contract they really cover their ***.
He has a legit issue after sale. Something broke. I doubt the dealer had anything to do with a cylinder having nearly 100% leakdown. That's not a problem that you can hide, or something that takes awhile to manifest. I don't think the dealer had any intent of screwing anyone.

It would be another story if it ran fine, and the MIL came on a few days after purchase for timing issues. That would be a technician clearing codes and sending it.

Sounds like they sold you and Evo that had some mods and was never tuned.
Ok so do this on Thursday go to the dealership and ask them to start a work order of your complaint.
U need this work order paper in case the extended Warranty denies your claim. This way the dealership is responsible
even after the 30 day dealer warranty expires.
Also make sure the work order does not state this
Customer complaint: Customer states The car will not go over 60mph
It needs to show These 3 things
Customer complaint: check engine light on
Customer complaint: customer states vehicle fuel cuts off above 50 mph
Customer complaint: vehicle is misfiring and idle is rough
Also I suggest start shopping around now for a stock Evo X intake complete
should be fairly cheap.
After the claim you can put back your intake.

+1, I agree 100%. Start a paper trail somewhere.

i forgot to mention this dealer sells sports cars like STI , Focus RS, Evos x and 9/8 and basic suvs and other cars this isn’t like a basic dealer that gets a sports car rarely

but dealer is 3 hours away from where i live but they did tell me over the phone to call back Thursday and they’ll discuss what will happen after but they don’t want me submit a claim yet

this whole thing giving me a headache haha

but we will see what happens I’ll mention the work order and see what goes on from there

I think what he means, is to have a repair order generated with an open date before the 30 days, so you have proof there was an issue, on paper, you can use against the dealer if the warranty denies the claim.

Update : dealer called the shop to get more info about it and turns out the issue was from my crankcase to cause the bad cylinder pressure

That's strange... How could a crankcase issue cause leakdown in one cylinder? And what issue could a crankcase have other than a hole in the sidewall?

shop assumes it’s a crankcase my bad but i already told them to start the tear down and get a exact answer won’t hear back till Monday lol .. dealer told me they got the car inspected it was 145 all across before i drove it off and said sparks and coils were new and it was tuned but I’m assuming the tuned wasn’t tuned correctly or else i wouldn’t been having issues you know ?

but i did noticed a oil leak on my garage floor but warranty said they’ll accept the claim but if it isn’t covered under their power train coverage ima have to pay out of pocket

Let us know what they find, I'm interested in the diagnosis.
The oil leak may be a separate issue, but some of the cheaper powertrain warranties won't cover gaskets or seals so watch out for that.

You need to take the motor apart. Could be multiple things. If it's under warranty get it fixed...

Damn! Well powertrain will cover that, but the warranty company is going to send an inspector probably to see why. Remove all evidence that the car has been modified or tuned if possible.
