first of all, sorry to hear about your incident, hope you get everything resolved in the end!
so now, here's what i have to say. if you're that worried about denying any fault, just do the work yourself. If you've got the tools, skills, determination, and time to do it you're set.
BUT
because you took it back to the dealer and your car is technically under warranty, if they were to deny fault, take a lawyer. there is no way any of your mods could have caused this accident and whatever or however tries to deny fault they wouldn't be able to prove it. the problem with this method is that it may take a while and of course there is a chance that the US legal system will fail you..meaning you may end up paying more.
It's all up to you.
