Guys run these "staggered" setups on different width wheels on Audi's and the X without a problem but I wouldn't personally risk it.

Off topic: Does anyone have an 9 lip laying around they don't need? Mine is broken and I don't feel like repairing it. The evo's starting to look goofy rolling around without a front lip
Speaking of which - Them Japs are crazy. I've seen their GT Race spec Evos with staggered FWD type setups.
ie:
Front - Larger Diameter Rims with Wider/Lower Profile Tires
Rear - Lower Diameter Rims with Narrower/Higher Profile Tires

Same rolling Diameters, but totally different tires and Rims sizes.
*shrugs*

just don't run a single wheel with a different rolling diameter for a month... and you should be fine.

needless to say - i am buying a set of 4 new winter tires this year, because i blew one.

I think the point you are missing is that unless you were throwing codes, you should have passed with the stock tune.
safety people don't care if your car runs like crap.

Again...what does tuning have to do with getting a sticker? You will pass as long as you aren't throwing a code.

tuning != disabling a CEL
