Can cop give me ticket for loud exhaust without decibel meter?

I got a ticket too, in NY though.
I went to pass a truck and didn't see the cop was 6 cars behind(In the morning commute, I just don't look be hind me)
He pulled me over all angry like. he said he can write me up for:
1: Speeding (okay, for a split second to 90MPH and back down to 70)
2: Front window tint ( It's legal at top 6" max, he didn't know)
3: rear window tint ( Again, legal)
4: Loud Exhaust ( Have you heard the Greddy?? Sorry, I can't hear you!!)
I showed him my PBA card which he dropped to the ground
He then wrote me a ticket for no muffler.
I have since then had the exhaust fixed(Yah right) and have an invoice to prove it.
Still waiting for the court to get back to me. But at least no speeding ticket.
Good luck on your case.

I asked a cop about harleys before and he told me that at least in washington state it is illegal to modify exhaust from stock...he said since harleys are that loud with the stock exhaust they're legal? he let me off the hook so i didn't argue but it didnt make sense to me since he said that he pulled me over for loud exhaust not modified exhaust

just pay the ticket and save u the hassle. Its happened to me numerous of times. They can give u a ticket for modified exhaust if its shiny. so the best thing i did was get a stealth blacked out muffler. done.

you cant "call the court" to have a charge dropped. Unless you live in hicksville indiana in a isolated small town, no court clerk will drop anything. You have to appear to fight any charges. You can hire a lawyer to appear for you. You might be able to mail something and take the chance the judge will look at the evidence prima facia and hope you win. But in all likelyhood you wont win/they wont accept your paperwork/you will be forced to appear to fight the ticket. Once there, you can get all the documentation you want, but like a previous poster stated, in nys anything louder than stock is a violation. If you somehow can get paperwork stating that your exhaust in 50 state legal in terms of decibles and and affidavit from a mechanic stating thats the exhaust from your car, you could win. Otherwise, just pay the fine. Its the cost of having a loud exhaust. you mod, you pay for the parts and all the extra attention you get from those parts.

I got a ticket for loud exhaust in PA and won very easy in court. not sure how the laws where you are read, but in PA the officer must use a dB meter and be trained to do so. Just saying an exahust 'seems' loud doesn't cut it. read up on the subject, know your rights and don't be afraid to stand up for them. you should NEVER just roll over and pay the ticket!
also, there is no law against running an aftermarket exhaust. if that were the case all those muffler shops (Aamco, Minekey, Monroe) would be shut down.

Don't know if this would help you, but in NJ the cop has to have a decibel readout to determine at what level it's considered illegal.
This info comes straight from a former NJ state trooper that happened to be my previous criminal justice professor.
Human ear can't distinguish sound levels like the cops can do with speeding so it requires the decibel meter. He says your ticket will be dismissed in court if the cop doesn't have it.
Mind you, he informed me of this about 3 years ago so I don't know if it's current. Hope this helps

that MAY be true, but you would need the proper equipment and be trained to use it in order to make that determination.

Depending on the state you can get a ticket. I know in new york state you are not aloud to modify your exhaust at all and they can pull you over and issue you an equipment violation.
What you could try to do if you have a friend or know someone that works in a mechanics shop is have them write a letter stating that the car had an equipment malfunction and you had an appointment to get it fixed when you got pulled over. and have them say that the issue has been since resolved. and see what happens...
